Abstract
In Costello v Government of Ireland [2022] IESC 44, the Irish Supreme Court invoked constitutional identity for the first time, in the context of deeming unconstitutional the Government鈥檚 proposed ratification of the Canada EU Comprehensive Economic and Trade Agreement (CETA). This paper explores the Court鈥檚 understanding of constitutional identity, its implications for European integration and for the ratification of CETA and future mixed agreements, as well as the capacity for constitutional identity to function as a constraint on legal powers.
